  1. *Call to order, open meeting compliance, roll call, prayer and pledge of allegiance.
    Meeting called to order at 10:00 a.m. Present: Kevin J. Phillips, Edwin Higbee, Jr., Paul Donohue, Paul H. Mathews, Wade Poulsen-General Manager, Dylan Frehner-Legal Counsel, and Shannon Simpson-Administrative Assistant. Absent: Adam Katschke. Prayer and Pledge said in earlier meeting of the Lincoln County Commissioners.

  2. Public Comment and Discussion. No public comment.

  3. *Discussion/Possible Action: Approve/Modify minutes from the Lincoln County Water District (LCWD) June 2, 2014, meeting. Motion by Paul Donohue to approve the June 2, 2014, meeting minutes, 2nd by Ed Higbee, motion passes unanimously.

  4. *Discussion/Possible Action: Approval of vouchers paid on check dates June 16, 2014. Motion by Ed Higbee, to approve the payment of vouchers for check dates June 16, 2014, 2nd by Paul Donohue, motion passes unanimously.

  5. Discussion: Board and Staff member reports:
    Wade:
    • Met with Brent Hafen in Barclay/Clovers. Talked to him about water that he wants to sell. The water is from the spring at base of Mathews Dam and is the water he wants to sell not the water in Barclay. Wade told him that if he has some water in Barclay to sell the LCWD would be interested in looking at a written proposal.
    • Ongoing conversations with Dennis Ryder over the Toquop Water. Sits on his desk to see what he can do and come back to us.
    • Meeting with the VVWD this Wednesday (7/2/14) to talk about our agreements and finalize the details. Wade has meetings set up for July 2 & 8. Wade would like to present to the VVWD Board first before their elections and their Board changes. Board agreed that because of the time sensitivity to have Wade make the presentation to the VVWD first, and then he will make a presentation to our Board as to how much we will pay for bulk water, what are the costs associated with the connection fees, what is the process, who will be responsible for what, etc. All of this information will be in the agreement that will have to be approved by the Board.

    Dylan:
    • Hired to be the City Attorney for Caliente beginning July 1, 2014

    .Board Member(s):
    • Paul Donohue – Met with the City of Mesquite. They want the water from the sewer. Think everything is okay. Didn’t want to pump the water back uphill to Lincoln County.

  6. Vidler Update.
    Ryan Hoerth:
    • Finished cultural assessment of the access road from I-15 to the Toquop power plant. Will be reworked and finalized over the next couple of weeks.
    • Filing an objection and protest where BLM is entertaining proposals for oil & gas leasing.
    • Continue monitoring efforts in all the other basins.

  7. *Discussion/Possible Action: Submittal of written comments concerning the U. S. Environmental Protection Agency and the U. S. Army Corps of Engineers proposed rule – Definition of Waters of the U. S. Under the Clean Water Act.

    • NACO submitted letter to the EPA and they have granted an extension to October. Dylan would like to wait until September/October before submitting letter.

  8. *Discussion/Possible Action: Proposed Resolution of Intent for the LCWD to proceed with an Inter-local Agreement with the Virgin Valley Water District to provide bulk water to the Toquop Development Area.

    • Changed the language from the agreement with Lincoln County; felt language was too strong.

    Motion by Paul Donohue to approve the Proposed Resolution of Intent for the LCWD to proceed with an Inter-local Agreement with the Virgin Valley Water District to provide bulk water to the Toquop Development Area, 2nd by Ed Higbee, motion passes unanimously.

  9. *Discussion/Possible Action: Resolution of Intent to proceed with an Inter-local Agreement between the LCWD and the City of Mesquite to provide sanitary sewer to the Toquop Development Area.

    • We have not had the discussion whether the County or the LCWD would do this.

    Motion by Paul Donohue to approve the Resolution of Intent to proceed with an Inter-local Agreement between the LCWD and the City of Mesquite to provide sanitary sewer to the Toquop Development Area, 2nd by Ed Higbee, motion passes unanimously.

  10. *Discussion/Possible Action: Providing comment(s) to the Bureau of Land Management on parcels of public land nominated for potential oil and gas exploration and development. The 30-day public comment period ends Friday, July 11, 2014.

    • BLM is looking for areas in Lincoln County to sell leases to for fracking.
    • The LCWD is concerned about the area in Tule Desert. The LCWD feels that oil and gas exploration is beneficial to the County, but they are not comfortable with this being done in the Tule Desert.
    • The LCWD wants to make sure that if this process is done it is done in a way that it will not impact our water.
    • When Dylan and Wade have a draft, the Board asked that it be presented to Paul Mathews before it is mailed.

    Motion by Paul Donohue to approve providing comment(s) to the Bureau of Land Management on parcels of public land nominated for potential oil and gas exploration and development, 2nd by Ed Higbee, motion passes unanimously.


  11. Public Comment and Discussion. No public comment.
